1. Agreement to Terms

By accessing or using our websites (including https://aghosh.inand related subdomains), our custom healthcare applications, appointment scheduling interfaces, API integrations, or consulting services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access or use the Services.

Throughout these Terms, “we”, “us”, “our”, and “Aghosh HealthTech” refer to Aghosh HealthTech Solutions(a Sole Proprietorship registered under MSME/Udyam in India, founded by Dr. Aghosh B Prasad). “Client”, “Doctor”, “Clinic”, or “You” refers to the individual or business entity subscribing to, integrating, or utilizing our Services.

2. Scope of Services

Aghosh HealthTech Solutions provides specialized digital healthcare solutions, including but not limited to:

• Headless Appointment & Scheduling Engines: Custom branded web interfaces integrated with Google Calendar API, Google Meet conference generation, and real-time availability synchronization.
• WhatsApp & Multi-Channel Communication Pipelines: Automation of appointment confirmations, pre-consultation questionnaires, telemedicine links, and reminder notifications via official Meta Cloud API and authorized communication gateways.
• Healthcare SaaS & Clinical Portals: Custom electronic health records (EHR) tools, telemedicine platforms, and practice management software for doctors and clinics.
• AI & IT Consulting in Healthcare: Digital transformation consulting, clinical informatics, and AI-assisted workflow optimization.

3. Third-Party Integrations & Communication Platforms

Our Services interface with third-party service providers to deliver seamless operational workflows:

• Meta & WhatsApp Cloud API:Where automated WhatsApp notifications or interactive booking workflows are enabled, usage is subject to Meta's Terms of Service, WhatsApp Business Messaging Policy, and applicable utility messaging regulations. We implement official, policy-compliant integration pipelines designed to protect clinic communication integrity.
• Google Calendar & Google Meet: Appointment scheduling and video conferencing features operate via Google Workspace and Google Cloud APIs. You are responsible for maintaining your Google account credentials and authorizing appropriate calendar permissions.

4. Healthcare & Medical Practice Disclaimer

Important Clinical Notice: Aghosh HealthTech Solutions is a health technology and software engineering provider. While our solutions are designed with clinical expertise, our software tools, automated scheduling engines, and notification systems are administrative and workflow automation tools. They do not constitute emergency dispatch systems, triage services, or medical diagnosis systems.

Healthcare practitioners and clinics remain solely responsible for direct patient care, clinical evaluation, medical record confidentiality, diagnostic decisions, and compliance with statutory healthcare regulations applicable in their jurisdiction.

5. Client Responsibilities & Data Accuracy

When utilizing our Services, you agree to:

• Provide accurate, lawful, and complete information regarding your practice, clinic operating hours, and contact details.
• Ensure all patient communication triggered through automated pipelines complies with applicable consent, anti-spam, and data protection requirements.
• Maintain the confidentiality of administrative login credentials, API keys, and OAuth connection tokens.
• Notify us promptly of any unauthorized access or security incidents impacting your connected accounts.

6. Intellectual Property

All custom source code, design systems, algorithms, proprietary templates, documentation, and visual brand assets developed by Aghosh HealthTech Solutions are protected under copyright, trademark, and intellectual property laws. Unless expressly specified under a dedicated client licensing contract, all rights remain the exclusive property of Aghosh HealthTech Solutions.

7. Service Availability & Maintenance

We strive to provide 99.9% uptime and high reliability for all custom deployment pipelines and hosted backends. However, scheduled maintenance, updates, or third-party platform interruptions (e.g., Google or Meta service outages) may occur. We provide proactive monitoring and support to resolve any unforeseen disruptions promptly.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Aghosh HealthTech Solutions and its founder, employees, or contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, clinic appointments, or goodwill, arising out of or in connection with the use or inability to use the Services.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes, claims, or controversies arising under or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the competent courts in Trivandrum, Kerala, India.

10. Modifications to Terms

We reserve the right to revise or replace these Terms at any time. Any changes will be posted on this page with an updated revision date. Continued use of our Services following any modifications constitutes acceptance of the new Terms.
